LIABILITY : Glanbia Nutritional’s (MWC and SWC)  shall not be liable to the customer and the customer hereby waives all claims against Glanbia Nutritional’s for injury or damage to persons or property sustained by customer or claims made against customer, resulting from any cause, including but not limited to (1) any accident in or about the banquet facility, including the parking lot, ; (2) any personal injury or property damage resulting directly or indirectly from an act of negligence of the customer, customer's guests, customer's employees, customer's agents, or customer's invitees; or (3) damage or loss of any equipment or supplies left on the premises prior to or following the event by customer, customer's employees, customer's agents, or customer's invitees. Customer hereby indemnifies Glanbia Nutritional’s in the event any and such claim is made against Glanbia Nutritional’s

INDEMNIFICATION : Each party mutually agrees to defend, indemnify, and hold each other harmless from and against and any all losses, liabilities, damages, expenses, injuries, costs, or obligations of any kind arising directly from their respective negligent and/or gross negligent acts that may occur during the course of performing this Agreement

STORAGE : Glanbia Nutritional’s will not be held responsible for the damage or loss of any merchandise or personal articles left on the premises of The Rawls Course at Texas Tech prior to or following the event. All items must be removed immediately following the event.

No promises written or implied have been made to any participant taking part in the event.

ALCOHOL POLICY : The Rawls Course at Texas Tech is a licensed facility and in accordance with the laws of the State of Texas, all alcoholic beverages MUST be purchased from and served by The Rawls Course employees. Organizers of the above listed event will be responsible for any violations of the alcohol policy by their attendees. No persons under the age of 21 will be served. Should the age of a guest be in question, proper identification will be required. The Rawls Course reserves the right to discontinue service of alcoholic beverages to any customer or group.
